The Seller is engaged in the business of gastronomic experiences, selling directly to the end consumer via the website https://theartoftastingportugal.com/.
The list and description of the products offered by the Company can be found on the aforementioned website. These terms constitute a contract between the Company and the person who purchases products from the Company, hereinafter referred to as the “Buyer” or “Customer.”
Article 1: Subject Matter
These Terms and Conditions define the rights and obligations of the parties involved in the online sale of products offered by the Seller.
Article 2: General Provisions
These General Terms and Conditions apply to all sales of products made through the Company’s website and form an integral part of the contract between the Buyer and the Seller.
The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The applicable terms are those in force on the date of payment (or the first payment in the case of multiple payments) for the order. These Terms are available on the Company’s website.
The Company ensures that the Customer’s acceptance of these Terms is clear and unconditional by means of a checkbox and a validation click. The Customer declares that they are aware of all these Terms and Conditions and acknowledges having received the necessary information and advice to ensure the offer meets their needs.
Article 3: Price
The prices of the products sold are indicated in Euros, inclusive of taxes, and are displayed on the product pages. The total price, including all taxes (VAT + other taxes), is clearly indicated in Euros on the order confirmation page. The Company reserves the right to change its prices at any time in the future.
Article 4: Conclusion of the Online Contract
The Customer must follow a series of steps to place an order:
- Access information about the essential characteristics of the product.
- Select the product, any available options, and provide essential Customer data (identification, address, etc.).
- Accept these Terms and Conditions.
- Verify the elements of the order and, if necessary, correct any errors.
- Follow the instructions for payment and delivery options.
Following the order, the Customer will receive an email confirmation of the payment and order receipt. Delivery will be made to the email address specified by the Customer. For the correct processing of the order, the Customer undertakes to provide their true identification data.
The Seller reserves the right to refuse an order in the case of any abnormal or bad-faith request, or for any other legitimate reason.
Article 5: Products and Services
The essential characteristics of the goods, services, and their respective prices are made available to the Buyer on the Company’s website. The Customer confirms having received detailed information on delivery charges, as well as the terms of payment, delivery, and performance of the contract.
The Seller undertakes to fulfill the Customer’s order within the limits of available stock. In case of stock unavailability, the Seller will inform the Customer. These contractual particulars are presented in detail and in Portuguese. The parties agree that any illustrations or photographs of the products for sale are for illustrative purposes only and are not binding.
Unless under special circumstances, the rights granted herein are solely for the person who finalized the order (holder of the registered email address).
In accordance with legal requirements, the Seller will refund or exchange products that are defective or do not correspond to what was ordered. Refunds can be requested via the following methods: PayPal or bank transfer.
Article 6: Retention of Title
The products remain the property of the Company until full payment is received.
Article 7: Availability and Fulfillment
Orders will be processed within the limits of available stock and subject to supplier availability. If an item is unavailable for a period exceeding 2 working days, the Customer will be promptly notified of the estimated delivery time, and the order for this item may be canceled upon the Customer’s request. The Customer may then request a credit for the value of the item or a full refund.
Article 8: Delivery Methods
Gastronomic Experience offers its customers a fast and convenient service.
Delivery Costs:
Deliveries are free of charge to any address provided by the Customer.
In the event of a stock shortage of an item or for any other reason within the Company’s responsibility, the Customer will be notified to choose a replacement item. If the Customer does not respond to the emails, Gastronomic Experience may substitute the items at its discretion without further consent.
Article 9: Payment
Payment Methods:
PayPal (a PayPal account is not required) – You can pay by credit card, MBNet, or with your PayPal account.
Article 10: Returns
The Customer has a period of fifteen (15) days from the date of receipt of the items to return their order without having to provide any justification and without penalty. This right of return can be exercised by contacting the Company via email at gastronomicsexperiences@gmail.com.
In case of a valid return, only the value of the items will be refunded. Returned products should, if possible, be accompanied by a copy of the sales receipt.
Article 11: Warranties
In accordance with the law, the Seller provides a warranty for the conformity and satisfactory quality of the items. The Seller will refund the Buyer or exchange products that are defective or do not correspond to what was ordered (please always read the product descriptions on the website).

Article 12: Complaints
If necessary, the Buyer may submit any complaint by contacting the Company via email at gastronomicsexperiences@gmail.com.
Article 13: Intellectual Property Rights
Trademarks, domain names, products, software, images, videos, texts, or any other elements subject to intellectual property rights are and shall remain the exclusive property of the Seller. No transfer of intellectual property rights is made through these Terms. The total or partial reproduction, modification, or use of these assets for any reason is strictly prohibited.
Article 14: Force Majeure
The performance of the Seller’s obligations under this contract shall be suspended in the event of a force majeure or unforeseeable circumstance preventing their execution. The Seller will notify the Customer of the occurrence of such an event as soon as possible.
Article 15: Invalidity and Contract Modification
If any provision of this contract is deemed void, it shall not result in the nullity of the other provisions, which shall remain in full force and effect between the parties. Any contractual modification is only valid after a written agreement has been signed by both parties.
Article 16: Applicable Law
All clauses contained in these General Terms and Conditions of Sale, and all purchases and transactions contemplated herein, shall be governed by Portuguese law.
